Crippled engineer gets Rs 19 lakh compensation

An engineer who was crippled for life by a speeding van in 2003 has been awarded a compensation of Rs 19 lakh, apart from interest, by a Delhi court.

NEW DELHI: An engineer who was crippled for life by a speeding van in 2003 has been awarded a compensation of Rs 19 lakh, apart from interest, by a Delhi court.
    
"A healthy person has been rendered invalid due to no fault of his own. His whole life has changed due to this accident," MACT judge Deepa Sharma said.
    
The court has directed the Bajaj Allianz General Insurance Company Limited to pay Rs 19 lakh, apart from interest, as compensation to Dev Ashish Nayyar who suffered from permanent disability after an accident.
    
Nayyar, 28, was on his way to his office in West Delhi on his scooter when a speeding Maruti Van overturned, after its driver lost control of the vehicle, inflicting serious injuries to the engineer.
     
The van was insured with the Bajaj Allianz General Insurance Company Limited which contesting the claim of nearly Rs 2 crore demanded by Nayyar.
    
"The accident which renders a person invalid not only affects the physique of a person but it also affects the psyche of a person and makes it difficult for him to cope up with his life," the Tribunal judge said.
    
Nayyar moved a petition before the Tribunal, claiming relief of nearly Rs 2 crore on account of personal, professional and physical loss due to the accident.
    
The Tribunal said that it was established from the manner in which the accident had taken place that the van was being driving at a fast speed.
    
"Had he maintained the required minimum distance and his vehicle had been at a normal speed, he certainly would have been able to stop his vehicle on seeing that the victim's scooter had stopped," it observed.

After examining the medical records of Nayyar, the tribunal said that the petitioner has suffered an injury in the spine due to which he developed weaknesses in the lower limb and was unable to move his foot.
    
"Nayyar has also been deprived of pleasures of life which normal person get. His pain and sufferings are for the rest of the life and no amount of compensation can reduce it," Sharma added.
