Vishal Yadav files appeal in High Court

Vishal Yadav, who along with his cousin, were sentenced to life imprisonment in the seven-year-old Nitish Katara murder case, moved Delhi HC challenging the trial court's conviction order.

NEW DELHI: Vishal Yadav, who along with his cousin Vikas, were sentenced to life imprisonment in the seven-year-old Nitish Katara murder case, today moved Delhi High Court challenging the trial court's conviction order.
    
A Division Bench of Justices B N Chaturvedi and P K Bhasin sought the trial court records on an appeal filed by Vishal and fixed November 17 as the date for hearing.    

Contending that the trial judge had ignored certain facts in the case, Vishal said the court relied upon the deposition of Ajay Katara despite the fact that he was an interested witness in case.
    
Vishal in his appeal also stated that the crime-related articles, including the wrist watch and the recovered murder weapon, were planted by the prosecution.
    
Claiming that there was no evidence against him to prove his involvement in the case, he said the post mortem report also did not establish the case against him.
    
In June this year, Vikas, son of Uttar Pradesh politician D P Yadav, and Vishal were sentenced to life imprisonment for killing Katara, an MBA and son of an IAS officer, as they were against their sister Bharati's intimacy with him.
     
The duo had kidnapped Katara on the night of February 16, 2002 from a marriage party in Ghaziabad and killed him.
    
Meanwhile, victim's mother Neelam Katara has filed an appeal before the High Court for enhancement of the punishment from lifer to death penalty for the convicts.
    
Vikas is yet to file his appeal in the case as his petition claiming that the Allahabad High Court should have the jurisdiction to hear the matter as the incident had taken place Ghaziabad, UP, is pending in the Supreme Court.
