BJP slams SDF govt on local employment bill

GANGTOK: The BJP on Sunday questioned the Sikkim government's sincerity on the promotion of Local Employment Bill without addressing its constitutional feasibility as the governor had returned an earlier bill giving 95 per cent jobs to the local people in the private sector on the ground that the bill violates Article 14 and 16 of the Constitution.

"The promotion of Local Employment Bill has reduced the reservation of jobs for the local people in the private sector from 95 per cent to 80 per cent, but at the same time, it does not address the governor's reservations on the bill," state BJP general secretary C B Chettri said in a statement here.

The Pawan Kumar Chamling government has failed to ensure that the local employment could stand the scrutiny of the provisions of the constitution by the governor, whose assent to the bill was must before it becomes an act, he said.

The BJP leader also had a dig at the SDF government for not giving reasons for reduction of the reservation of the local people from an earlier 95 per cent to 80 per cent and reserving the remaining 20 per cent for other people, Chettri said.

On the state government's contention that it wants to protect the rights of the local people under the Article 371 (f) of the constitution as well as Sikkim government service (establishment) rules, 1974, the BJP leader sought to know as to how these provisions could override Article 14 and 16 of the constitution.

Observing that the local employment bill could be made an act only after its ratification by parliament and insertion in the ninth schedule of the constitution so that it did not attract a judicial review, Chettri expressed reservation whether the UPA government would extend support to the bill.

Under the circumstances, it was unlikely that the bill would see the light of the day to benefit the unemployed youth, the BJP leader said, adding the bill was aimed more at wooing the educated unemployed electorate ahead of the assembly polls due next year rather than creating employment opportunities for them by way of the 'flawed' bill.
