Compensation of Rs. 2.60 Lakh

A consumer court here has asked Bajaj Allianz General Insurance Company to pay Rs 2.6 lakh, including insurance claim of a Maruti van.

NEW DELHI: Pulling up Bajaj Allianz General Insurance Company, a consumer court here has asked it to pay Rs 2.6 lakh, including insurance claim of a Maruti van, to its owner whose vehicle was completely damaged in an accident.

"It seems that the company is always on a look out for an opportunity to reject the claim. Since it was a case of total damage to the vehicle, it is liable to pay full amount of insurance of Rs two lakh," the New Delhi consumer forum President K K Chopra said.

The forum also held the company guilty for deficiency in service and causing mental harassment and agony to complainant V K Jain whose two acquaintances had died in the accident.

It also awarded him a compensation of Rs 50,000, besides legal costs of Rs 10,000.

"The injuries and death certificates support the complainant that it was a complete damage and with a view to avert collision with cattle, which appeared all of a sudden, the accident became imminent as the driver lost control," the forum noted in its order.

Jain's counsel Sunil Kumar submitted that the car was damaged completely following an accident at Bahadurgarh Road when the complainant and his family members were on their way to Harayana to participate in a fair 'Pathri Mela'.
 
"Complainant's son Saurabh and his friend Rajiv Mittal had sustained injuries while his friend's sister-in-law Neelam and nephew Shivan had died in the accident," Kumar said.

The company, on the other hand, had denied the insurance claim of the vehicle claiming that it was being used for commercial purpose.

The forum rejected the company's contention and asked it to pay the insurance claim as well as due compensation to the complainant.
