Hari Masjid case now with CBI

The state government has no difficulty in handing over the police ‘enquiry’ of firing at Hari Masjid in the spate of riots in 1993 to the Central Bureau of Investigation (CBI), according to submission made in the Bombay High Court on Wednesday.

In the letter written by principal secretary (special) K Subramaniam on September 27, public prosecutor Satish Borulkar told the high court that the state government has decided to hand over the ‘enquiry’ to the CBI.

“But there is a difference between enquiry and investigation,” Justice RMS Khandeparkar said. The investigation is handed over to the central agency; it would mean registering of an offence against and filing of a First Information Report.

Borulkar, however, said it was for the CBI to decide what course of law it wants to take after taking charge of the probe.
