Court acquits man of bigamy charges

A man was acquitted of the charges of bigamy with his sister-in-law after the victim said that she had remained with the him under the influence of black magic.

NEW DELHI: A court here has acquitted a man of the charges of bigamy with his sister-in-law three years ago after the victim deposed that she had remained with the accused under the influence of black magic.
    
"Her (girl) testimony is too unrealistic. She wants this court to believe that she was under the influence of black magic. In the present era of science and technology, the story of black magic is totally untenable," Additional Sessions Judge Narottam Kaushal said.
    
The court exonerated Sandeep of the charges under Sections 494 (marrying against during the lifetime of husband or wife), 363 (kidnapping) and 366 (kidnapping for marriage) of the IPC.
    
The accused, along with the girl, was produced in the police station Narela in West Delhi on June 23, 2004 by his own father Dhirey about four months after a complaint by girl's father Kumar.
   
Kumar had alleged that Sandeep, who was married to one of his daughters, had enticed another daughter of his.
   
The girl, in her testimony, said that the mother of the accused performed some black magic on her and that's why she had gone with the accused.
   
She further deposed that she had not maintained any physical relation with Sandeep. She also denied that the accused had married her.
    
After the examination of 10 witneses, the court said that there was no evidence to establish that the girl was enticed away or forcibly taken away.
    
"There is no evidence of physical relationship or marriage between them," it said, adding that since the girl was between 16 and 18 year of age, she was of the age of discretion.
