Youth moves HC, alleging wife kidnapped by in-laws

A Muslim youth has filed habeas corpus petition in the Bombay High Court, alleging that his Hindu in-laws are keeping his wife in confinement, preventing her from cohabiting with him.

MUMBAI: A Muslim youth has filed habeas corpus petition in the Bombay High Court, alleging that his Hindu in-laws are keeping his wife in confinement, preventing her from cohabiting with him.

The petition filed by Thane-based Naseem Shah Ansari also alleges that Babu Bajrangi -- prime accused in Naroda Patiya massacre in Vadodara in post-Godhra riots -- was instrumental in abduction of his wife. It also names VHP leader Pravin Togadia for allegedly intimidating his brother.

A division bench of Chief Justice Swatanter Kumar and Justice Dhananjay Chandrachud has issued notice to the girl's father Vasantji Shah seeking reply within a week.

As per Naseem, he met and fell in love with Chaitali Shah in Thane. Chaitali left her house to marry him since her parents were not likely to accept marriage to a Muslim boy.

They got married on May 30 this year after Chaitali converted and took a new name Zeenat, he claimed. However, on July 22, a team of police from Gujarat came calling with a warrant in Zeenat's name.
   
Zeenat was informed that a magistrate's court in Gujarat has issued the warrant on the basis of complaint filed by her grandmother under section 380 of IPC (theft in dwelling house) and taken to Raper in Gujarat.
   
Naseem's brother Amir and friend Javed accompanied her but the petition alleges that when they reached Raper, a mob led by Babu Bajrangi beat the two men mercilessly.

VHP leader Pravin Togadia, who was in the town to attend some function, too came to the place where they were being held and slapped and abused them, it alleges.

Zeenat was released on bail but Bajrangi's men forcibly took her away and handed her over to her parents, the petition alleges.

Incidentally, there had been similar allegations against Bajrangi in the past too. Last year, some Maharashtrian youths had filed habeas corpus petition in the High Court, alleging that Bajrangi had abducted their wives -- all girls of Patel caste -- at the behest of girls' parents.
   
But the High Court dismissed the petition as the girls themselves refused to back the story in the court.
