What is the significance of an FSL report in convicting culprits involved in drunken driving cases?

In any conviction, fool-proof scientific evidence plays a very important role. The FSL report provided to the court is the final phase in the conviction.

What is the procedure, after a person is booked under drunken driving act and his blood is sent for medical examination?

After a person is caught driving under the influence of alcohol, he is sent to a hospital for medical examination and his/her blood sample is given to FSL.

We analyse the content of alcohol in the blood and if it over the permissible limit, suitable action is initiated against that person and he can be directly convicted.

We (Mumbai FSL) have an instrument called a ‘Headspace Gas Chromatography’, which makes the analysis of alcohol content in the blood very fast and accurate. This instrument is used in foreign countries too. A report is sent to authorities by the FSL in a day or two.

What is the use of breath-analyser?

A breath-analyser can only give an indication that a person is driving under the influence of alcohol. It is basically the screening test. But the exact content of the alcohol could be known only in the laboratory.

Do you think FSL reports are given more weightage in the court of law in drunken driving cases, abroad as compared to India? What is the procedure in such cases elsewhere?

FSL reports are vital not only in cases of drunken driving but also in almost all criminal cases. Courts, both in India and abroad give top priority to FSL reports.

Earlier, did all cases relating to drunken driving come to your laboratory for testing or has it begun after the special drive of the traffic police?

Earlier we used to get only special or important cases of drunken driving. But since the drive began, we have sent around 250-300 reports to the police.

Have you made any special arrangements to deal with the rise in the drunken driving cases?

We have asked our men to work hard so that all reports can be processed on time.

Approximately how many cases of drunken driving come to FSL?

Around 10-12 cases daily.
