HC extends relief to CA, architects on conversion charge

The Delhi HC exempted chartered accountants and architects from paying conversion charges and one time parking cost for the use of residential premises.

NEW DELHI: The Delhi High Court on Friday exempted chartered accountants and architects from paying conversion charges and one time parking cost for the use of residential premises for professional activities after giving a similar relief to lawyers and doctors.

"Prima facie, chartered accountants and architects are professionals like lawyers and doctors and they should be also given similar treatment," a bench comprising Justice Vikramjit Sen and Justice S L Bhayana said extending the relief.

"The Centre, MCD, NDMC and DDA are restrained from giving effect to the regulation of November 20, 2006 and the subsequent notices on issued on June 17, 24 and 26, 2007 shall also remain in abeyance till next date of hearing," the bench said.
   
DDA had come out with Regulation in November 2006 imposing payment of conversion charges and one-time parking cost from professionals for the use of residential premises for professional activities.

The MCD on June 17, 24 and 26, 2007 had issued notices under the said regulations for the registration, annual conversion charges and one-time parking charges from the professionals.
   
The last date for depositing registration, conversion and parking charges was June 30.

Earlier, the Delhi High Court had on June 29 stayed the DDA's regulation with respect to lawyers and doctors.

Rakesh Tikku, counsel appearing for CA and architects, contended that Regulation of 2006 was contrary to the Master Plan 2021 which did not mention either conversion charges or one-time parking charges.
