Cops’ conflict lets accused slip

The evidence produced in the court was full of so many contradictions that it became impossible for the judge to believe the prosecution’s story.

A tantrik met his end, allegedly at the hands of the husband of a woman he failed to cure of persistent stomach ache. The husband was acquitted of the murder charge by Sessions judge BM Jethani on Tuesday. Abdul Ghani Usman was charged with the murder of Munnababa on May 4, 2004, opposite the Mafatlal Swimming Pool at Marine Drive.

Despite the fact that all the witnesses were policemen and the accused was caught red-handed, the evidence produced in the court was full of so many contradictions that it became impossible for the judge to believe the prosecution’s story.

Constables Baban Avadh and Sanjay Kadav (Marine Drive Police) were patrolling the area at 7.10pm on May 4, 2004, when they saw a man in a hacking a fallen body with a chopper. On seeing the police, the man ran away. Kadav chased the man and caught him. He was later identified as Ghani. Avadh took the injured man to Nair Hospital, he was joined by two other constables from DB Marg police station.

Senior officers from the both police stations arrived at Nair Hospital and after a lot of legal wrangling, decided that the Marine Drive police would complete the formalities and  file the case.

All the constables and their senior officers testified before the court, but contradicted each other on material aspects of the murder, including the murder weapon and the spot.

The motive for the murder which came to the fore during the hearing was very interesting. Tantrik Akeel Munnababa Shah failed to heal Rubina of stomach ache.

She died soon after the treatment. Though there was nothing to connect Munnababa with the lady’s death, Ghani believed otherwise and allegedly killed the tantrik.

Munnababa succumbed to fatal injuries in his chest and abdomen, 3 days later in hospital.
