Cockroach inside Chaywanprash, manufacturer fined Rs 30,000

A south Delhi resident, who bought a one-kg pack of Himani Sona Chandi Chyawanprash from a dealer, found a dead cockroach inside the pack.

NEW DELHI: A cockroach in a sealed pack of Chaywanprash has proved costly for its manufacturer Emami Limited as a city consumer court has asked it to pay Rs 30,000 as damages, including compensation, to the buyer.

The Delhi State Consumer Disputes Redressal Commission headed by Justice J D Kapoor and Member Rumnitta Mittal rejected Kolkata-based Emami's contention that the complaint was motivated as the process of sealing the jar was mechanical and automated, nullifying the possibility of foreign objects entering the pack.

"Instances are not rare where foreign objects have crept into airtight sealed bottles or packages where the manufacturers claim foolproof automatic process of bottling or packing," said the Commission, ordering Emami to pay Rs 5,000 to buyer Sunita as compensation and to submit another Rs 25,000 as punitive damages with the Consumer Welfare Fund.

Holding the company "guilty of negligence and deficiency in services", the Bench said it "cannot be oblivious of the fact that in such like process one in hundreds or thousands of packed or sealed articles, a foreign object is found" which may harm users if consumed.

The order came on an appeal filed by Emami against the order of a district consumer forum which, finding the firm guilty of negligence, had asked it to pay Rs 77,000 as compensation.

Sunita, a south Delhi resident, said she had bought a one-kg pack of Himani Sona Chandi Chyawanprash from a dealer of Emami. To her utter shock, she found a dead cockroach inside the pack.

The complainant, in a state of shock, approached M/s Pharm Assist, a dealer of the company at Sainik Farm, which rejected her allegations as a blackmailing attempt forcing her to approach a District Forum.

Her complaint was allowed by the forum.

Against this, the company appealed to the Commission, which, upholding the forum's verdict, scaled down the compensation amount from Rs 77,000 to Rs 30,000.
