Court puts off bail proceedings of J&K sex racket accused

A local court deferred indefinitely proceedings on the bail plea of ten people, including two former J&K ministers.

SRINAGAR: A local court on Saturday deferred indefinitely proceedings on the bail plea of ten people, including two former Jammu and Kashmir ministers, arrested in connection with the sex racket, saying it could not take a decision since the Supreme Court had ordered transfer of the case to Chandigarh.

 

Principal district and sessions judge Mohammad Yaqoob Mir put off hearing on the bail applications of the accused, including former ministers G A Mir and Raman Mattoo, DSP Mohammad Ashraf and Mehraj-ud-din Malik, citing the transfer and saying he could not give any ruling until he received a copy of the apex court order.

 

On September 4 the Supreme Court directed that the trial and all other proceedings of the 14 accused be transferred from Srinagar to the Chandigarh District and Sessions court.

 

"The situation has changed as the Supreme Court has transferred the case to Chandigarh. I have no power or jurisdiction to act...till the copy of the order of the Supreme Court was received. My action will be deemed as a violation of the Supreme Court order," Mir said.

 

He told the accused not to approach his court since the case had been moved to Chandigarh. "I will convey my decision to the jail authorities soon after receipt of the order of the Supreme Court.... If it is received today or tomorrow I will not delay the decision and will communicate to the jail authorities immediately," he added.

 

To a plea by the accused that they were ready to foot the bill of a judicial officer for taking the case to Chandigarh, the judge said he will consider the request.
