SC warns judicial officers illegally occupying houses

Exasperated over the conduct of some judicial officers in Uttar Pradesh unauthorisedly occupying government bungalows in Lucknow, the Supreme Court on Wednesday warned them of even suspension if they failed to vacate the premises forthwith.

NEW DELHI: Exasperated over the conduct of some judicial officers in Uttar Pradesh unauthorisedly occupying government bungalows in Lucknow, the Supreme Court on Wednesday warned them of even suspension if they failed to vacate the premises forthwith.

"What these judicial officers are doing is something unbecoming of a judge," a bench of Justice B N Agrawal, Justice P P Naolekar and Justice L S Panta observed while issuing show cause notices to five such judicial officers who have unauthorisedly retained the official accommodation in Lucknow despite being transferred to other places.

The notices were issued through Registrar General of the Allahabad High Court to Additional Sessions Judge (AD J) P K Agnihotri, Santosh Kumar Pandey (ADJ, Rampur), Meena Yadav (ADJ Sitapur), Piyush Kumar (District Judge, Badaun) and Jagdish Prasad (Additional Civil Judge, Maharajganj).

The bench said if by the next date of hearing these officers of Subordinate and Higher Judiciary did not vacate the accommodation in Lucknow, then the High Court will take action against the deliquent judicial officers.

he notice was also issued to the heirs of a deceased ADJ Ashok Kumar Singh with the bench asking the HC Registrar General to serve the notice upon them.

Expressing its anguish against the members of judiciary for unauthorisedly retaining the government accommodation away from the place of employment, the bench observed "why they should not be suspended or dismissed for occupying the house".

"If they are not vacating, we will direct the High Court to suspend them," the bench said, and added that "it was the misfortune of this country that instead of vacating the premises gracefully like a veteran litigant they are fighting the eviction proceeding initiated against them".
