'Two J Dey articles angered Rajan'

In the 3055 pages-long charge sheet filed in the J Dey murder case, Mumbai police have submitted three confessional statements.

In total, 176 witnesses were examined in the case. Volume 1 of the charge sheet contains the FIR, while Volume 2 consists of a panchnama, ballistic report, postmortem report and identification parade which together total 334 pages. The charge sheet also includes statements of witnesses and mobile phone records.

Till now, 11 people have been arrested in the case, including journalist Jigna Vora, even though her name does not feature in the charge sheet. Underworld don Rajan and his aide Nayan Singh have been shown as wanted accused. Asrani has been booked for having helped the shooters identifying Dey at Uma Palace Bar. Waghmode and Nayan Singh have been booked for providing weapons to the murderers.

“We have mentioned two news items in the charge sheet, which were published in the tabloid Mid-Day. One was published on May 30, 2011, the headline of which was ‘Did Kaskar get shot by Rajan’ and another on June 2, with the headline ‘Rajan people off to pilgrimages’. This triggered Rajan’s anger towards Dey,” said joint commissioner of police, crime, Himanshu Roy. According to the charge sheet, Rajan was upset due to the two articles, and wanted to set an example whereby if other journalists tried to demean him in their articles, they too would be facing similar consequences.

The police said that they will be filing a different charge sheet in Vora’s case. With Vora in their hold, the police are trying to figure out the exact motive behind Dey’s murder. They are currently collecting evidence that would show that it was Vora who instigated Rajan against Dey due to their professional rivalry. They are, meanwhile, waiting for the forensic report of Vora’s laptop and mobile phone, which will ascertain whether Vora e-mailed Dey’s details and the copy of the two mentioned articles to Rajan to instigate him, a senior police officer said.

Police will also summon Vora’s friend Murtuza Diwan, who submitted an application in the MCOCA court stating that he wanted to submit four cell phones and SIM cards which Vora had given him to safeguard. He also raised the fear that he might be arrested for recovery of the cell phones.

The court has refused to grant him interim bail in the matter and asked the crime branch to file a reply. “Murtuza was not aware of the law, and has therefore directly approached the court. We will be summoning him for questioning and to go through the mobile phones and recordings,” said a police officer.
