Slain matka king's mum claims his properties

Maniben Bhagat, 80, has filed a civil suit against her estranged daughter-in-law, Jaya Chheda, and grandson Hitesh.

The mother of the matka king, Suresh Bhagat, has moved the Bombay high court, claiming to be the rightful owner of his multi-crore property. Maniben Bhagat, 80, has filed a civil suit against her estranged daughter-in-law, Jaya Chheda, and grandson Hitesh. According to her, Jaya and Hitesh can not claim rights to the property as they are the main accused in the alleged murder of Suresh. Jaya and Hitesh are lodged in Taloja jail.
In his suit, Maniben seeks appointment of a court receiver on Suresh’s properties in Mahabaleshwar, Valsad and a few other places in and around the city. Valued at around Rs100 crore, they are said to be in possession of Jaya and Hitesh. Maniben also urges the court to declare her as the sole heir to her late son’s ‘estate’.

She has made Suhas Roge, a co-accused in the murder case, a respondent, alleging that he too has claimed rights to her son’s properties through a power of attorney issued by Suresh to one Nilesh Chandrakant Hate.

The suit alleges that Jaya, Hitesh and Suhas had plotted the murder of Suresh. It also says that Suresh had got a whiff of the conspiracy in 2006, and had lodged a complaint with the police. Maniben accuses Hitesh of misusing Suresh’s insurance policies to obtain a loan of Rs55 lakh from the Life Insurance Corporation of India Ltd, Dombivli branch, in May last year.

Defending his rights, Hitesh filed an affidavit last week. “The suit has been filed by Maniben at the instance and instigation of my uncles — Jayantilal, Vinod and Dipesh Bhagat. My uncles are interested in illegally grabbing the properties of my father and therefore, they pressurised my grandmother to file this suit,” he has said in his affidavit. He has also claimed that Maniben used to reside at Mundra in Kutch, but has now shifted to Mumbai at the instigation of his uncles.

Justice VM Kanade has appointed a court receiver. The matter will come up for hearing next week, said Sanjay Jain, advocate for Hitesh.

Bhagat was killed in a suspicious road accident in June last year. Police arrested Jaya, Hitesh and Suhas following  a complaint by Suresh’s family. The cops had slapped MCOCA on the trio, but a special court discharged them of it. The three are now facing trial under the Indian Penal Code.
