Reply to delay charge, high court tells Narayan Rane

The Bombay high court on Tuesday directed state revenue minister Narayan Rane to file his reply to a petition by Swabhiman Sanghatana member Chintu Shaikh. The petition alleges that the police have delayed arresting Rane’s son, Nitesh, because of the Congress leader’s interference. Shaikh has alleged that Nitesh fired at him last month.

A division bench of justices AM Khanwilkar and PD Kode heard a petition filed by Shamim, alias Chintu Jamaluddin Shaikh, who is the president of the Sanghatana’s transport wing. Nitesh heads the organisation.

In his petition, Shaikh stated that there has been no progress in the investigation except for the recording of the panchnama and the statement. He has urged the court to “transfer the investigation to the CBI”. He has also sought directions to an “independent authority to conduct inquiry into the alleged inaction/delay in investigations.”

“Inaction of the state clearly indicates that the police are slow, as there appears to be a controlling and monitoring authority to see that they did not proceed speedily,” the petition states.
The judges directed all respondents, including Rane, to file their replies by November 15, 2010, and adjourned the matter to November 19, 2010.

According to Shaikh’s petition, the incident occurred on September 23, 2010. An FIR was registered with the Khar police station under Section 307 (attempt of murder) of the IPC against Nitesh and two others. On September 24, 2010, the CEO of Hiranandani hospital, where he was treated, announced that the injury was not caused by a bullet. Rane then held a press conference denying Nitesh’s involvement. Shaikh’s petition states that while he could not access the medical report, it was readily given to Rane. “This clearly shows interference by the minister,” the petition states.
