Rape accused MLA’s bail rejected

MLA Dilip Wagh, who is in magisterial custody remand (MCR) in a gang rape case was rejected bail by the sessions court in Nashik on Tuesday.

A case was filed against the Pachora MLA and his personal assistant Mahesh Mali by a complainant accusing them of molesting and raping her. The case was filed in Sarkarwada police station in Nashik on Feb 23, stating that the incident took place in government rest house in Nashik two days earlier.

The two accused were arrested in Mumbai and remanded in police custody by  the Nashik court. Later they were given MCR.

The lawyer of the accused, advocate MY Kale on March 18 had submitted a bail application which was heard on Monday.

Pleading for his client, Kale stated that there is no reason for further detention, as the case stands weak since the complainant filed a case two days after the said incident. He asked the court to grant bail, and added that the accused is a member of the legislative assembly and an elected representative, and that the assembly session is currently underway. “He is a reputed member of the society,” Kale stated.

The police prosecutor in his argument stated that bail should not be granted as investigations were going on in the sensitive case.

Hearing the two sides, the court reserved its judgment for March 22. On Tuesday the court rejected the application and sent the accused back into custody.
