The special privilege given to the ministers and bureaucrats has led to creation of two categories of citizens and defeated the vision of the founding fathers of the nation to change the perception of the state functionaries from ‘rulers’ to ‘public servants’.

This was what the Supreme Court observed while asking the state government to clarify its stand on the special privileges given to public servants.

Two weeks ago, SC gave a notice on the state home department directing it to submit its detailed stand on the privileges given to ministers and bureaucrats.

The SC, in its letter dated November 2, has raised questions over the legality of the privileges. While responding to the petition filed by lawyer Harish Salve, the apex court said it’s time to examine whether the country should have two categories of citizens. “One category enjoys all sorts of privileges at public expense and allowed to use different kinds of symbols representing authority of the state in the pre-Independence era, while the fundamental rights of life and liberty to other category is not protected,” it said in the notice.

The home department has sent the copies to director general of police, transport department, chief minister and deputy chief minister for their opinion. An official from the department said that though the observations by the SC are worth it, the state cannot go against the existing system.

“It’s true the beacons and escorts are a blatant violation of the state mechanism, our reply would not oppose it for the obvious reasons,” the official said.
