The Israeli couple is in Mumbai for the past two months along with their twins born to a surrogate Indian mother. They have been barred from taking the babies to their home country by the Jerusalem family court.
Orna Sagiv, counsul general of Israel in Mumbai, said, “The case involving the Israeli gay couple and their twins is in the court now and they are very optimistic. Thus they do not want to speak to any local media as of now.”
This incident has brought to the fore the acute need of surrogacy laws in India.
“Lack of proper legislation is fuelling speculations in other countries,” said surrogacy law expert Amit Karkhanis.
According to Karkhanis, English-speaking countries like the US are aware of the Indian laws. “But the non English-speaking countries like Israel may have problems. For them, no legislation means something is dicey.”
Director of department of IVF, Jaslok Hospital, Dr Firoza Parikh said, “This particular case reflects more on laws of the country where the commissioning parent resides. This case does not reflect on guidelines set by the ICMR. It would be prudent on the part of parents coming to India for surrogacy to check the legal requirements in their country.”
Dr Kedar Ganla, fertility consultant at Hiranandani Hospital, said: “We certainly need a law as surrogacy involves more than a couple seeking a child. There are chances of misconduction of the treatment for which we need apt laws and punishment for their violation.”
