No evidence against Lilavati hospital trustee, police tells Bombay high court

In a reprieve for Chetan Mehta, reporting trustee of the multi-speciality Lilavati Hospital, Bombay high court has held that criminal proceedings against him in a case of alleged assault on permanent trustee Niket Mehta have become infructuous as police did not find any evidence against him.

Accordingly, Justice RC Chavan removed all restraints imposed on Chetan Mehta who was facing charges of assault on Niket Mehta and disposed of proceedings against him.

The court had earlier asked him to obtain permission of the sessions court in case he wanted to travel abroad and also inform police about his travel plans in advance.

The order was passed on November 22 after police informed the Court that investigations in the assault case were over and chargesheet had been filed in a local court.

Police also said that no evidence was found against Chetan Mehta and hence he was not an accused any more in that case.

"In view of this, there is no question of putting Chetan Mehta under any restraint. The proceedings, therefore, have become infructuous and are disposed of as such. All orders stand vacated," Justice RC Chavan observed.

On September 6, the court had granted anticipatory bail to Chetan Mehta and asked him to seek leave of sessions court in case he wanted to travel abroad and inform police about it.

Chetan Mehta sought bail as he feared arrest in the case filed by Niket alleging that he was assaulted by some persons at the instance of Chetan Mehta.

Members of Mehta family are locked in a legal battle over control of the Rs700 crore Lilavati Hospital.
