The Gamdevi police have registered a First Information Report (FIR) of cheating against the medical superintendent, nursing staff and three doctors of Jaslok Hospital for allegedly overcharging a patient who was admitted for treatment.

A division bench of justices AM Khanwilkar and RG Ketkar, while transferring the case to Mumbai Crime Branch observed: “It is not worthwhile to entrust investigations to the local police.” The court also noted that the accused have all the rights as per law and can take to legal recourse before the appropriate court.

The directions came during the hearing of a petition filed by a retired doctor, Dr Namdeo Madhav Sonar who alleged that he was overcharged for the medicines given to him and tests which were never conducted, during his stay at the hospital in 2008.
Advocate Pritam Runwal, appearing for Sonar argued before the court: “Our complaint was transferred to the Gamdevi police and still no further action is being taken against the doctors.”

The government has been told to comply with the order and transfer the investigations to the crime branch and adjourned the hearing till December 3.
