Calls to repeal penalties on illegal constructions in Pune

The Pune city improvement committee (CIC) of Pune Municipal Corporation (PMC) has demanded the civic body to refrain from slapping steep fines on those buildings in the city that do not have commencement and completion certificates.

Arun Dhimdhime, chairman of the city improvement committee (CIC), in a letter to the municipal commissioner, Mahesh Pathak, claimed that the move to slap steep fines by PMC is illegal.

"Section 267 (A) of the Bombay Provincial Municipal Corporation Act (BPMC), 1949, talks about fining illegal construction. However, the same section does not specify the amount, so the commissioner is at fault for slapping such a steep fine," he argued.

Last year in December, the then municipal commissioner Mahesh Zagade had hit upon the idea of fines to curb the growth of illegal constructions in the city.

According to Zagade's proposal, buildings being constructed without commencement certificates and buildings being used without completion certificates would be slapped with fines double the property tax levied on the property.

Commencement certificates are issued before starting of the constructions, while completion certificate is mandatory before occupying the building.

At present, about 30% of the buildings in the city are operational without completion certificates.

This move by Zagade was criticised by the elected corporators who had claimed it would add additional burden on the citizens. However, some of the civic activists are unhappy with the demands of CIC.

Civic activist, Sandeep Khardekar, criticised Dhimdhime's move. "Zagade's proposal was diluted by all the parties under the pressure of the builders' lobby. Further dilution of the proposal would be disastrous for the city as far as illegal structures are concerned," he said.
