Blame your son for your sufferings, says Bombay high court

The Bombay high court on Tuesday told Avinash Singh, a businessman from Nashik, that his son was to blame for making him do the rounds of police station.

The remark came while the court was hearing a habeas corpus petition filed by Manpreet Biji, 31, whose husband, Nanak Singh, has absconded with their four-year-old son since January 2008. A division bench of justice BH Marlapalle and justice Anoop Mohta observed that investigation in the said case will go on till Nanak surrenders in court with his son Guruashish.

Representing Nanak’s father Avinash, advocate Subhash Jha argued that his client, who is a senior citizen, his wife, children, relatives and business associates are facing continuous police inquiries.

“Nanak Singh is a major and he is not in control of his father. How can a father, who is a natural guardian of a child, be called as his abductor,” Jha argued. He urged the court to let off Avinash Singh and his younger son Tinku Singh from the case as they were facing harassment without any reason. 

Justice Marlapalle quipped: “What can we do? Blame your son for your sufferings. Nobody is putting you in jail, but you will have to face police inquiries till your son appears in this court. Advise your son to come to the court.”

The judges observed that Nanak has taken away Guruashish from legal custody of Manpreet. “The report submitted by CBI indicates that you are in touch with your son and he is involved in selling of cars. He is in Mumbai and you also know it,” observed the judges.  
The court has adjourned the case till July 26 and directed Tinku Singh to remain present in court. 

The high court had handed over the case to the CBI in 2009. Early this year, the court had called the then DGP AN Roy and directed him to monitor the case personally.
