Aurangabad arms haul accused appeals for bail to mate with wife

The Bombay high court rejected the bail application moved by Mohammed Amir Shakheel Ahmed, a 2006 Aurangabad Arms haul case accused, who wanted to be released as he wanted to become a father and mate with his wife, claiming it to be his fundamental right.

The Bombay high court on Friday rejected the bail application moved by Mohammed Amir Shakheel Ahmed, a 2006 Aurangabad Arms haul case accused, who wanted to be released as he wanted to become a father and mate with his wife, claiming it to be his fundamental right.

However, the court refused any relief and directed the Central Bureau of Investigations (CBI) to begin the trial as early as possible.

The letter written by Ahmed from Arthur road prison was heard by single judge Abhay Thipsay, and rejected. The letter said “I married my wife on December 1, 2005 and was arrested five months later on May 9, 2006, for the alleged offence of being a part of the conspiracy and carrying huge amount of explosives.

After marriage, it is my duty to take care of her and her needs.” The letter also cites other reasons like delay in beginning of the trial for which he has already spent over five years behind bars and also incorrect application of charges under the Maharashtra Control of Organised Crime Act (MCOCA).

However, special public prosecutor Raja Thackeray informed the court, “As decided earlier, after the train blast case, the 2006 Aurangabad arms haul case will begin. The trial is going on a daily basis and an approximate time of around nine months would be taken to complete the case.” Thackeray, who refrained himself from reading the contents of the letter, said “I agree it is a fundamental right but with reasonable restrictions.”

Twenty-one accused have been in custody in the arms haul case. For over three years the trial had been stayed after co-accused moved the supreme court challenging a charge levelled against them. In February last year the stay was vacated and the trial has been on schedule.
