Adarsh affidavits: More blame game, less truth?

Former Brihanmumbai Municipal Corporation (BMC) commissioner Jairaj Phatak had endorsed the view that there was no need for members of the Adarsh Cooperative Housing Society (CHS) to take separate permission from the high rise committee (HRC) to increase the height of the tower, the BMC told the two-member panel probing the Adarsh scam on Wednesday.

As per the BMC affidavit, the members of the Adarsh CHS held a meeting on October 14, 2009 in the commissioner’s chamber.

“Adarsh members and the architect pleaded that the structural design of the building was submitted for the height of 103.40 metres to the HRC. But architectural plan was submitted for 97.60 metres. Hence there was no need to go back to the HRC to ask for permission to increase the height,” said the affidavit.

The affidavit has mentioned that the then-municipal commissioner endorsed that there was no need to obtain fresh NoC from HRC. However, MMRDA’s approval may be obtained.

The letter attached as an annexure to the affidavit shows the sign of the then municipal commissioner. Former Mumbai collector (from June 17, 1999 to August 20, 2002) Debashish Chakraborty and Parish Kapse, director, Team One Architect (the architects of Adarsh) also filed their affidavits on Wednesday. All three affidavits have blamed other agencies for any possible irregularities in the proceedings of Adarsh CHS. Kapse’s affidavit claims that the society had made it clear that all important NoCs such as heritage, environment, CRZ and height would be sought by the society at their entire cost. While Chakraborty in his affidavits mentioned a circular of October 7, 1987 whereby certain powers of collector were delegated to the superintendent of land records.
