3 lakh petty crime cases to be withdrawn in Mumbai

The Maharashtra government and the high court have decided to withdraw cases of petty offenses that are pending in dormant status in the lower courts. It will appoint two-level committees that would identify the cases that cannot be run anymore as they have lost the relevance due to the passage of time. Nearly 3 lakh cases are expected to be withdrawn.

The issue of the time barred or the dormant cases in the metropolitan and district magistrate court was discussed at the meeting between the chief justice of the high court Mohit Shah and chief minister Prithviraj Chavan on Friday. The government was apprised with the rate of pending cases in the state and the ways it could be reduced. A large number of cases of the petty crimes registered for smaller offences like prohibition, gambling, violation of motor vehicle rules, drinking related crimes have reportedly are dormant and needed immediately to withdrawn. Some of the cases are outdated, while in some other the parties relevant do not appear before the court for the hearing.

The state decided to form two-level committees, one on district and another on state level, to study the cases that can be withdrawn immediately. “The state level committee will frame the guidelines based on which the policy will be framed to identify such cases. Based on it, the district committees will decide on the cases that will be withdrawn,” said VL Achaliya, principal secretary, law and judiciary department.

“There are nearly 28 lakh cases are pending in various courts in the state. Of them the petty offence cases that can be withdrawn range between 3 and 5 lakh. The central and state governments are fast pushing the policy to reduce the pending cases in various courts. The drive to withdraw the petty offences will help us in contributing in the reduction of pending cases,” said an official.

High court also has demanded to set up a National Law School at Mumbai beside the one decided to be set up at Aurangabad.
