1997 accident victims get justice 12 years later

Twelve years after being injured in a freak accident, Madhavi Shitole and R Chandrashekhar finally received justice on Saturday when the Bombay high court directed the woman driver accused of injuring them to pay a compensation of Rs50,000.
 
Justice Roshan Dalvi set aside the three months simple imprisonment conviction given to Nalini Nayar, 42, but fined her Rs50,000, which will now be paid to Shitole and Chandrashekhar. The court was hearing an appeal filed by Nayar, challenging a sessions court order sentencing her to three months simple imprisonment in a case of rash and negligent driving. 

According to Nayar’s appeal, Shitole and Chandrashekhar were waiting at the Vasant Vihar bus stop in Thane on January 13, 1997, when a Maruti car driven by Nayar rammed into a wall adjacent to the bus stop. Both Shitole and Chandrashekhar sustained several injuries and fractures on their legs and hands.

Nayar was subsequently booked by the local police under sections 279, 337, 338 of the
Indian Penal Code (IPC) and section 184 of the Motor Vehicles Act, for rash and negligent driving causing grievous injury. A metropolitan magistrate had convicted Nayar for one year simple imprisonment in January, 1999. She had then moved the Thane sessions court, which had reduced the sentence to three months simple imprisonment.

Following this, Nayar filed an appeal in the Bombay high court in 2000, which came up for final hearing last week. As the accused was not traceable, Justice Dalvi has directed additional public prosecutor Anuradha Mane to trace her and produce her in court. Nayar was on bail pending the hearing of her appeal. She was present in the court on Friday, as were the victims.
