The forum, thus, asked the two to pay an amount of Rs80,387, which the consumer had paid towards transaction, along with 10 percent interest rate on the amount from the year 2013.
The Mumbai suburban district additional district consumer dispute redressal forum held an online bidding firm and one of its registered members guilty of using unfair trade practices while entering into a deal with a customer.
The forum, thus, asked the two to pay an amount of Rs80,387, which the consumer had paid towards transaction, along with 10 percent interest rate on the amount from the year 2013. The forum, further asked the firm to pay an amount of Rs30,000 towards the complainants mental agony and an amount of Rs10,000 towards his litigation costs.
According to Laxman Chaudhari, a resident of Andheri, he had gone through the official website of E-Bay, where he noticed an auction of loose diamonds and jewellery sets put up by Lalita Nagpal — a registered member with the bidding firm. Chaudhari was interested in purchasing them, hence, he took part in the bid and won the auction.
"Before purchasing the loose diamonds and jewellery sets, he has gone through the description of those articles and accordingly made the payment. However, when he received the parcel, he was shocked to see that the loose diamonds and jewellery items were not as per the description provided by Nagpal and the articles were not genuine. Some of the diamonds were of poor quality and some of the diamonds were not as per the quantity and description mentioned," read the complaint
Further, Chaudhari had immediately contacted Nagpal, but neither the online trading firm nor Nagpal paid attention to his grievance. He further issued a legal notice to the two, but again the two did not pay heed to the notice. Finally, he approached the consumer forum and registered a complaint.
