DNA EXCLUSIVE: BMC offers more FSI with conditions

Floor Space Index of up to 4 for medical and up to 5 for educational and other institutional buildings has been proposed

The Brihanmumbai Municipal Corporation (BMC) in the proposed Development Control Rules 2034, which will be released soon after the government's consent, has proposed floor space index (FSI) of up to 5 for medical institutions and up to 4 for educational and other institutional buildings. However, the increased FSI will be provided to registered public charitable trusts with a rider that 20 per cent of the total beds and free treatment will have to be given to economically weaker section (EWS) and below poverty line (BPL) individuals. In addition, 10 per cent of the total number of patients in the out-patient department (OPD) will be provided treatment at the rates charged in government hospitals.

A BMC deputy commissioner, who did not want to be named, told DNA, "Such a facility, proportionate to cited percentages, will have to be made available by medical institutions in a separate building or wing or if that is not possible, then on a separate floor. Out of the additional FSI beyond Zonal (basic) FSI, 50 per cent may be availed by utilising transferable development right (TDR) without payment of premium. The state director of health services will be the competent authority for the observance of these norms and determination of penalties for breach of conditions." He informed that it will be mandatory for the medical institution to file an undertaking to abide by the cited terms and conditions before allowing utilisation of 50 per cent of additional permissible FSI beyond Zonal (basic) FSI.

Dr Surendrakumar Mathur, ex-professor of surgery at the GS Medical College, said the intention is good but implementation matters. "The government needs to appoint an independent regulatory authority comprising medical professionals and members from civil society to check that the medical institutions availing higher FSI strictly follow the norms," he noted.

As far as higher FSI to educational institutions in concerned, BMC has pointed out that it has to be strictly utilised for bonafide education purposes only. "Such institutions will make some rooms available to the government as and when required and 10 per cent of the total seat capacity will have to be reserved for government nominees on the recommendation of the state education department. The Directorate of School Education, Higher and Technical Education will be the competent authority for the observance of these rules and fixing penalties," the deputy commissioner said.

Dr HS Palep, founder of Medical Research Foundation, said that the will go a long way to help the poor to get the benefit of state-of-the-art facilities from tertiary care institutions. "Even in the education sector, those students from weaker sections can avail facilities in premier educational institutions to further their educational careers at an affordable cost," he said.
