Builder dupes senior citizen of Rs1.66 crore, FIR lodged

Buyer was promised flat on non-existent 18th floor

76-year-old Shekhar Shetty was a happy man when he had paid Rs1.66 crore for a plush 1,395 sq ft flat on the 18th floor of a highrise building in Govandi. However, he was shocked when he learnt that the building has only 16 floors. Duped by RNA Corporation builders, who constructed the building, Shetty lodged a complaint with the Govandi police.

An FIR was registered on Monday after the police in their preliminary investigation found substance in the complaint that was filed by the victim four months back. Late Anil Aggarwal (chairman), Anubhav Aggarwal (MD), Gokul Aggarwal (Joint MD), Mehul Parekh and other Directors of RNA Corporation builders have been booked by the police under sections of 406 (criminal breach of trust) and 420 (cheating) of IPC.

Shekar Shetty was approached by broker Chandrakant Vaswani in 2009. Vaswani informed him about a project at Worli called Miraj by RNA Corpration under the name of GA Builders Pvt Ltd. Shetty alleged that he, along with Vaswani, went to see the project and finalised a flat on the 15th floor of the building. "I paid Anil Aggarwal Rs45 lakh in cash and Rs5 lakh in cheque as booking amount," said Shetty.

Alomst after one and a half years, Aggarwal told me that the project has some issues and will take time to complete. When I asked Aggarwal to return my money, he told me about another project called RNA Continental at Subhas Nagar in Chembur. I agreed."

In 2011, Shetty along with Vaswani went to see the Chembur construction. Shetty alleged that there he was introduced to Anubhav, Gokul and Mehul. "When I went to their Chembur site office, only three floors of the building had come up. I was shown the detail plan of the building and they explained me at length about flat no C/1803 on the 18th floor of the building," said Shetty. "I decided to buy it and the modalities of payment were worked. I booked the flat which at that time costed me around Rs1.60 crore".

Over a period of time Shetty paid Rs1.66 crore and the builders got the flat registered in his name. "In October 2011, I came to know that there was no plan to construct 17th and 18th floors of the building. When I made enquiries, I came to know that the building had permissions only till 16th floor."

Shetty alleged that after realising that he was cheated, he approached the RNA Corprations office and the office bearers assured him that he will be given another flat. "I was assured of another flat, but I was not even allowed to meet Anubhav and Gokul," said Shetty.

When contacted, Mehul Parekh, who is also named in the FIR, said: "It's a simple miscommunication and that will be resolved soon. After the chairman died, his son took over and they were not aware the deal with Mr Shetty."

Senior PI of Govandi police Khanderoa Vidhate said, "We have registered an FIR against RNA Corporation for cheating. We registered an FIR after we found that the complaint made by Shetty was true and further course of action will be taken."
