Pop star Ke$Ha a has decided to take legal action against the owners of an Illinois-based watch strap firm which has branded its latest product by a name similar to her hit song ‘Tik Tok’.

The singer has instructed her lawyers to fire off a cease and desist letter to Wimo Labs bosses on April 11, claiming their product's name, TikTok, was in "flagrant and conscious disregard" of her rights, reports Contactmusic.

Wimo Labs executives however have filed papers and requested a federal court in Chicago to declare their TikTok watch strap as constituting no infringement of Ke$Ha 's copyright, because consumers are unlikely to associate the star with the product.

Ke$Ha's song became a chart smash worldwide in 2009, launching her as a pop star.
