Victims become accused in cheating case in Ahmedabad

In a bizarre case of cheating, the victims of a fraud were made accused in an FIR filed by the police in the same case! The victims then approached the court for anticipatory bail, which the court granted after prima facie perusal of the case.

According to the case, the partners of Surya International wanted finance for their expansion plans and had applied for a loan from Oriental Bank of Commerce (OBC).

In the meantime, they were approached by a firm named Chowdhury Investments which claimed that they had tie ups with various banks. The firm offered to play a facilitator's role in getting the loan from OBC.

Eventually, both the parties entered into a financial deal whereby the investment company was to provide loan of 3 cores at 15% interest. 

As a part of transaction the Surya International issued four cheques worth 1 crore in all towards the interest on the loan and processing fees. In return, the investment company issued demand draft of 3 crores to Surya.

However, when the company deposited the DD in the Ahmedabad branch of the bank, it was found that the draft was fake.The bank then informed the partners of Surya, who decided to lodge a police complaint against the investment company.

When partners of Surya International approached the Naranpura bank on December 6, they were not entertained. Hence they filed a private complaint with the metropolitan court. The court however, on December 8, passed an order directing the police to investigate the case.

Ironically, the bank also filed a complaint against the partners of Surya International on the same day. Fearing arrest, the partners then moved the sessions court for anticipatory bail.

While arguing the case, advocate AR Gupta submitted that the partners of the firm are innocent and are implicated in the case. However, the public prosecutor submitted that the investigation is at the preliminary stage and they need to collect further evidence to come to any conclusion.
