Additional sessions judge VK Vyas on Monday deferred his verdict on the bail plea of whistleblower IPS officer Sanjiv Bhatt to October 10. At the same time, principal district judge GN Patel, who is hearing the Gujarat government's revision petition seeking Bhatts's custody on police remand, also said he will pronounce his order on the maintainability of the petition on Monday.
The additional sessions judge was to pass the order on Bhatt's plea for bail on Friday itself but the judge adjourned the case saying that he could not write the order and would pronounce his verdict on October 10.
Hearing on Bhatt's petition opposing the state government's revision application will continue on Monday. On Friday, his advocate, IH Saiyad, completed his arguments, and SV Raju, appointed special public prosecutor (SPP) for the case, commenced his argument's against Bhatt's application. He would continue his arguments on Monday.
Concluding his arguments against the government revision petition for Bhatt's custody on police remand, Saiyad stated that Bhatt had been falsely implicated on the basis of a false FIR. The state government was behind the fake FIR because Bhatt had raised his voice and filed affidavits revealing the truth behind the communal riots of 2002.
Further, he had refused to surrender to the demands of the chief minister (who is also the home minister) to destroy the evidence in Haren Pandya case, Saiyad said. He further contended that Section 195 and 194 of the IPC under which Bhatt had been booked does not apply in the case. Raju, however, refuted the allegations and said he would continue his arguments on Monday.
