YS Sachan's wife Malti had sent an application to the deputy inspector general of police asking him to lodge a case of murder.
A case of murder was today filed in the mysterious death of Deputy Chief Medical Officer YS Sachan in a jail here on his wife's complaint even as a top official called it a case of "homicide and not suicide", discounting the Uttar Pradesh Police theory.
"An FIR under section 302 (murder) and 120B (criminal conspiracy) has been lodged at Gosaiganj police station against unidentified persons on an application moved by Sachan's wife Malti Sachan," Deputy Inspector General of Police Lucknow DK Thakur said.
Thakur said that the FIR was lodged on the basis of a complaint sent by Malti Sachan to the station officer through speed post.
The main accused in the murder of Chief Medical Officer (Family Welfare) BP Singh, 52-year-old Sachan was found dead under mysterious circumstances in jail hospital toilet on Wednesday night after which the government ordered a judicial probe into the incident and suspended five jail staffers, including a jailor.
His post mortem report revealed nine injury marks on the body including on neck, elbow, thigh and wrist.
The DIG maintained that the case will be investigated only after the judicial probe is over. Both the probes cannot be conducted parallelly."
Meanwhile, YS Pathak, Joint Director, UP Medico-Legal Department, claimed that all the wounds on Sachan's body could not have been inflicted by him and prima facie it looked to be a case of homicide and not suicide.
"Injury No 9 could not have been self-inflicted. It was caused by other persons after Sachan's death. It was inflicted to make the case appear as suicide. His body was hanged to make it look like suicide. All the wounds could not have been inflicted by Sachan himself. Prima facie it is a case of homicide and not suicide," Pathak said.
Alleging that Sachan was murdered, his family members had rejected the police's suicide theory and demanded a CBI inquiry into the incident but it was ruled out by Mayawati government.
The family said even though the FIR should have been registered earlier, the authorities have now conceded that it could be a case of murder.
"The FIR should have been registered earlier. At least now the government has conceded that it could be a case of murder in the FIR. Our demand for a CBI inquiry stands as everyone knows how the police carry out investigation in this state," the DyCMO's brother RK Sachan said.
Sachan's son Sankalp said, "My father was going to reveal who killed the CMO and that is why he was murdered. He was killed just a day before the hearing. Why has the state government not called for a CBI inquiry into murders of three CMOs," he said and alleged that some in the government were linked to the case.
Echoing the demand for the CBI probe, the opposition Congress and BJP expressed apprehension that registration of the FIR could be an eyewash to "smudge" the entire case.
"It is a very preliminary step, I feel that only a CBI inquiry can bring out the facts. Filing of FIR has no meaning in 'Maya Raj' because there are thousands of FIRs pending in police stations in the state," UPCC chief Rita Bahuguna Joshi said.
"The system is to give it for some sort of inquiry, in the inquiry they smudge up the case. She (Mayawati) has already ordered magisterial inquiry but within 2-3 days it will again come out that it was a case of suicide," she said.
BJP spokesperson Ravishankar Prasad claimed that it was clear that if Sachan "opened his mouth, then the names of several eminent people would have been revealed".
"Two cabinet ministers had resigned and a lot of suspicious circumstances are there. He (Sachan) was to be present in court in two days before this happened. All this can be examined only by a CBI inquiry, independently," he said.
DIG Thakur said that the Chief Judicial Magistrate, who is already conducting an inquiry on the directives of the state government, would be informed about the FIR.
On Friday, Malti had sent an application to the DIG asking him to lodge a case of murder.
Thakur, however, said that he hasn't received the application addressed to him yet.
