Underworld don Babloo Srivastava approaches court for bail in MCOCA case

Underworld don Babloo Srivastava, who is in jail since his extradition in 1995 from Singapore, today approached a Delhi court seeking bail in a case lodged under stringent MCOCA for running organised crime syndicate here during 1983-1997.

Additional sessions judge JR Aryan, who took the bail application into records, asked the record keepers to ensure that the judicial file, which is now before the Delhi high court, is brought back.

The case file is with the high court as Babloo had filed a revision petition there against the lower court's order of framing of charges against him under Maharashtra Control of Organised Crimes Act.

The bail application, filed through advocate DB Goswami, said "the accused is in jail for the last 16 years. Since the witnesses in the present case are either police personnel or the court staff ... there is no possibility of tampering with the evidence."

Moreover, besides the present FIR, no other criminal case was lodged against the accused in the last 10 years, it said, adding no purpose would be served by keeping him in custody.

While fixing the plea for hearing on August 23, the court said the special prosecutor be intimated about the filing of the application.

Earlier, the court had framed charges against Babloo under the MCOCA and his aide Fazal-ur-Rehman for allegedly running organised crime syndicate here.

Babloo and Rehman had denied their involvement in any crime syndicate and wished to face the trial. Later, the don challenged the order in the high court.

The duo have been accused of running organised crime syndicates here during 1983-1997. An FIR under MCOCA was lodged against them by the Delhi police in 2006.

Babloo and Rehman were allegedly involved in 43 cases each, including of murder, attempt to murder, kidnapping for ransom, extortion and other offences punishable under TADA and Arms Act in different parts of country, including Delhi, police had claimed.

Rehman, a resident of Darbhanga in Bihar who was arrested from Indo-Nepal border in 2006, is in judicial custody in Tihar jail.

Rehman allegedly ran his crime syndicate from his base in Dubai and was associated with Babloo, police said.
