Tribunal holds Centre from appointing head of Armed Forces Medical Services

The tribunal's order came on a petition by Lt Gen Pradeep Bhargava alleging that an attempt was being made to supersede him.

The armed forces tribunal today restrained the Centre from appointing the director general of the Armed Forces Medical Services after Lt Gen Pradeep Bhargava alleged that despite being the most senior, an attempt was being made to supersede him.

Hearing Gen Bhargava's petition, the tribunal's bench headed by justice SS Kulshreshtha said no appointment would be done to fill the vacancy of director general until further orders.

The post will fall vacant when Lt Gen Naresh Parmar retires on June 30.

Bhargava urged the tribunal to direct the government to quash the changes made in the annual confidential record of another officer, Lt Gen Naresh Kumar, on April 26, saying this would hurt his chances of heading the medical service.

The bench also put a stay on the changes made in the ACR of Gen Kumar.

Gen Bhargava, director general of hospital services, argued that Kumar was junior to him and the changes made in his ACR would make him senior and thus the front-runner for heading the medical services.

Under the changes, Kumar was given a higher grade in his ACR when he was brigadier. If the changes were accepted, he would be considered for promotion as per the 2007 selection board, making him a year senior to Bhargava in service.

Both Bhargava and Kumar were cleared for promotion from the rank of major general to lieutenant general by a selection board in 2008 after being rejected earlier in 2007.

In his plea, Gen Bhargava contended that there was an "underhand design" in giving redressal to Kumar in his ACR, which was written when he was a brigadier.

Gen Kumar currently heads the Delhi-based Army Research and Referral Hospital.
