Tihar jail inmate convicted for trying to kill co-prisoner

The judge convicted Wasim Mohd for attempting to murder fellow inmate Sunil by hitting him with a brick on his head while he was sleeping.

A Tihar inmate has been held guilty by a local court of trying to kill a co-prisoner while he was sleeping in a park on the jail premises early this year.

Additional Sessions Judge OP Gupta convicted Wasim Mohd for attempting to murder fellow inmate Sunil by hitting him with a brick on his head on February 2.

"I feel that ends of justice would be met by sentencing the accused for imprisonment already undergone (8 months). The accused is sentenced to imprisonment already undergone and fine of Rs1,000," the judge said.

"The injury was caused on vital part viz head. From the same it can be inferred that accused had knowledge that his act can be fatal," the judge said.

Wasim, 32, facing trial in another case, was brought to Tihar jail from Punjab two or three days prior to the incident.

He and other inmates were sitting in park of the jail while victim Sunil was sleeping on a blanket with his back towards Wasim. The other inmates deposed in the court that Wasim hit Sunil with a brick and tried to run from the spot when he was chased by police personnel. Sunil fell unconscious and was taken to DDU hospital.

The court rejected Wasim's argument that Sunil had failed to identify him as his assailant.

"The victim became unconscious after receiving injuries. He was declared unfit for statement in DDU hospital and even in Ganga Ram hospital after about 13 days. So he cannot be expected to identify the assailant," it said, while relying on deposition of other inmate eyewitnesses who incriminated Wasim.
