In a development in the Surat gangrape case, Babu Pathan, the only defenne lawyer, has demanded that narco tests be conducted on the 17-year-old victim and her friend Dhaval who was a witness.

In his application filed with chief judicial magistrate, Pathan who is the advocate for one of the accused, Abu Bakr, claimed that circumstantial evidence in the case and police reports are contradictory to each other. He sought permission for a narco test on the victim and her friend.

In his application before judge R Raval, Pathan said that looking at the circumstantial evidence and place of crime, there are many facts which are still unrevealed.

The case which was earlier with the Athwa police is now transferred to Khatodara police station which suggests that the police was still unclear about the place of crime, said Pathan. The hearing of the application will be on Thursday.

“In the complaint, the victim and her friend have said that they were asked by the accused to go to the police station. There is a doubt that they both were in a compromising position when the accused approached them. The three rapists had asked them to sit in the car and said they would free them in 10 minutes. But why did the two willingly agree to sit in the car. These questions can only be answered through narco tests,” Pathan said.

Advocate Pathan also raised suspicion that why Deepak Swaroop, then police commissioner of Surat, said that victim and Dhaval were in uncompromising situation? This clearly suggests that even the police hve not disclosed some facts.
