Sohrabuddin case: CBI court reserves order on Jirawala's bail

Jirawala is the owner of Arham farmhouse on the outskirts of the city where Sohrabuddin and his wife, Kausarbi, were allegedly kept by the Gujarat police before their death.

The CBI court, on Monday, reserved judgment till November 3 on the bail application of Raju Jirawala, an accused in the Sohrabuddin Sheikh fake encounter case. Jirawala is the owner of Arham farmhouse on the outskirts of the city where Sohrabuddin and his wife, Kausarbi, were allegedly kept by the Gujarat police before their death.

Arguing for the bail application, Jirawala's lawyer HN Dhruv said that, in the first chargesheet in the case filed by the state CID, the Arham farmhouse owner was shown as a witness in the case.  "Even the first chargesheet of the CBI filed by the probe agency after the arrest of IPS officer Abhay Chudasma makes no mention of him," Dhruv said. "But shockingly he was arrested by the CBI three days later though the probe agency has no evidence against him."

"Jirawala had no knowledge of the conspiracy and was falsely implicated by the CBI in a case in which the state CID had listed him as a witness," Jirawala's lawyer said.

He further said that except for the allegation that Sohrabuddin and his wife Kausarbi were kept at his farmhouse before their death, there was nothing against Jirawala as he had played no role in the case.

"And even if the allegation that Sohrabuddin and his wife were kept at Arham farmhouse is correct, it does not prove that he had knowledge of the crime," said Dhruv. 

The CBI, however, opposed Jirawala's bail plea and alleged that Jirawala was one of the conspirators as Sohrabuddin and Kausarbi were kept at his farmhouse with his knowledge. After hearing the arguments, the special CBI sessions court reserved judgement in the case till November 3.
