SIT opposes parting with probe report

The suspense over clean chit to Gujarat Chief Minister Narendra Modi from the Supreme-Court appointed Special Investigation Team (SIT) in the 2002 communal riots continued on Monday.

A court of metropolitan magistrate MS Bhatt, on Monday, adjourned the matter till February15 after SIT strongly opposed sharing of its report with activist Teesta Setalvad, lawyer Mukul Sinha and victims of Gulbarg society massacre.

The court was hearing applications filed by victims and activists seeking copies of the supposedly final report filed by SIT on February 8.

SIT had conducted probe into the complaint of Zakia Jafri seeking prosecution of Modi and 63 others for their failure and complicity in the riots.    

The SIT has filed 550-page report, which has many documents including statements of hundreds of people connected to the case.

Zakia Jafri, Citizens for Justice and Peace (CJP), Amrish Patel, witness of the Naroda Patiya case and one Fakir Mohammad, victim of the Gulbarg society massacre had sought copies of the report.

They had argued that they should be provided a copy of the report and all documents related to the case so that they could know the conclusion of the SIT and then decide the future course of action.

However, RS Jamuar, counsel for SIT, strongly opposed it saying, "There is no locus standi of any of the parties seeking the report. Even Zakia Jafri is nowhere as the party of the case as per SC ruling in the issue." Explaining circumstances in which the report could be given, the counsel said, "Only after the court decides to close the complaint holding that there is no evidence, the copies could be given to the original complainant (Zakia), as per the Supreme Court's order."
