Private firm withdraws plea accusing CBI of torture in NHAI case

The firm, in its plea, had alleged that the probe agency was "humiliating and torturing" its officials, who were questioned but not arrested during the probe.

A private construction firm, whose managing director KS Bakshi was arrested along with two top officials of National Highway Authority of India (NHAI) in a corruption case, today withdrew its plea in which it had accused the CBI of torturing its officials during the probe.

"The application stands withdrawn after the applicant Oriental Structural Engineers Pvt Ltd (OSEPL) submitted that the grievances are no more existing," special CBI judge OP Saini said.

The court had yesterday asked CBI to reply to allegations that it was "torturing" officials of the firm.

The firm, in its plea, had alleged that the probe agency was "humiliating and torturing" its officials, who were questioned but not arrested during the probe.

Bakshi, MD of OSEPL, and an employee SK Dixit were arrested along with NHAI chief general manager SK Nirmal and general manager Nitin Jain by the CBI on May 25. They are in judicial custody till June 14.

Earlier, the court had dismissed the bail plea of Bakshi and Dixit, saying the probe in the case was at an initial stage and considering the gravity of the offence, they did not deserve to be released.

The agency has alleged that the NHAI officials entered into a criminal conspiracy with the MD of the private firm and favoured it in bagging contracts for projects in Maharashtra and Madhya Pradesh.

The officials allegedly gave key confidential, strategic and vital information to the company during the tendering process, which, in turn, helped it gain greater financial benefits, it said.

CBI claimed that it had recovered Rs2.41 crore and Rs46 crore, in cash, from the two senior NHAI officials.

The NHAI officials allegedly abused their official positions to help the private firm bag bids relating to the construction work, the agency said.

Besides the cash, CBI also claimed to have recovered 360gms of gold and five kgs of silver from the bank locker of one of the accused.
