Principal, held guilty in graft case, moves HC

A former government school'sprincipal, who did not mind attesting wrong examination forms, including those with fake names and fictitious photographs like those of slain ramp model Jessica Lall for petty bribes and ended up with three year of jail term, has moved the Delhi High Court against his conviction and the sentence.

On a plea by 70-year-old former Principal Kailash Chand Nirmal of Sarvodaya Bal Vidyalaya at Vikaspuri in West Delhi, against his conviction, Justice VK Shali today issued notices to the city police, seeking its reply by September 4.

Nirmal was sentenced to three years in jail on March 22 this year by a trial court which held him guilty of attesting the CBSE examination forms in 2001 for class-X and XII private students after taking Rs100 each from them and without even verifying the particulars like names and photographs on them.

"The instant case demonstrates modalities of corruption being adopted by such higher officer like the Principal, having no hesitation in taking bribe of Rs100 to Rs200 for attesting the 10th and 12th Class CBSE Examination Forms, carrying photographs of even dead persons including the then famous model Jessica Lall and showing their fake names and addresses, only out of lust for money," Additional Session Judge BR Kedia said, while convicting Nirmal for corruption.

The court, however, had granted interim bail to him till April 21 while allowing him to file appeal in the high court.

In his appeal to the high court, Nirmal has contended that he was implicated in a false case by a teacher with whom he was not on good terms.

The prosecution had made Jessica's sister Sabrina Lall a witness in the case.

The trial court had accepted the testimony of Sabrina who had denied any such application in the name of Asha with the photograph of her sister Jessica Lall, who was murdered in 1999.

The case came to be registered in 2002 on the complaint of Sunaina, the secretary of Samdrishti People Care Foundation Society.

The complainant got to know that Nirmal was engaged in attesting CBSE examination forms of private candidates going to appear in 10th and 12th board exams without proper verification.

In order to substantiate her case against him, the complainant had sent several CBSE forms by affixing the photographs of various deceased girls and showing their fictitious names and addresses and the same were attested by Nirmal for Rs100 each.

After the senior authorities concerned failed to take any action, she moved the high court, seeking legal action against Nirmal. It led to Nirmal's prosecution by the Anti-Corruption Branch.
