No immediate relief to Kanimozhi, HC issues notice to CBI

Extending no immediate relief to DMK MP Kanimozhi, the Delhi High Court on Wednesday issued notice to the CBI on her bail plea alongwith four others arrested for their alleged role in the 2G scam.

Justice VK Shali issued notice to the CBI after hearing arguments from both the sides and directed the investigating agency to file their response by December 1.

Besides Kanimozhi, the four others who have moved the high court against a special court order denying them bail on November 3, are DMK-run Kalaignar TV MD Sharad Kumar, Kusegaon Fruits and Vegetables Pvt Ltd directors Asif Balwa and Rajeev Agarwal and Bollywood producer Karim Morani.

Appearing for Kanimozhi, senior advocate Altaf Ahmed contended before the bench that the trial court has ignored the CBI’s willingness to allow bail to the five accused and said, “When CBI did not raise any objection over granting bail to these five accused, then why the court ignored the same?”

Kanimozhi counsel also told the court that the CBI’s apprehension that his client (Kanimozhi and Sharad Kumar) will flee from justice was baseless, as the court can impose condition while granting relief to the client.
