Mumbai court orders gas firms to pay Rs1 lakh to fire victims

A south Mumbai consumer court recently granted over Rs1 lakh compensation to a family after a fire broke out in their kitchen in 2007 and injured a family member.

Ashok Pokharkar, a businessman from Ghatkopar, and his wife Sujata had moved consumer redressal forum stating that they had availed the services of Kumar Gas Service, an agent of Hindustan Petroleum Corporation.

A defective rubber piece connected to the gas cylinder led to a fire on June 19, 2007. They said their nephew, Gyaneshwar Khillare, suffered severe burns.

The Vikhroli Fire Brigade filed a report saying that the fire was caused due to gas leakage from the rubber tube.

The Pokharkars alleged that representatives of Kumar Gas came to their house and tampered with important evidence, including the gas cylinder, gas kits and the rubber tube.

Kumar Gas, through an affidavit, said the family was negligent and didn’t change the tube when it was damaged.

However, SB Dhumal, president of the forum, and member Jyoti Iyer on April 23 held that both Kumar Gas and Hindustan Petroleum were liable in this case.

“In our opinion, it is the duty of opposite party no 1 and 2 to see that proper and defect-free goods are supplied to the consumers and the services which are rendered should also be up to the mark as these are emergent situations which are life threatening,” the court held.

Both parties were ordered to pay jointly or severally Rs55, 000 for medical expenses, Rs50,000 for damage to property, and Rs5,000 for cost of litigation.
