Bimla Tyagi, who had contested the MCD election from ward no 7, Burari on a BJP ticket, moved the court of Additional District Judge Seema Maini.
A BJP candidate, who lost the April 15 North MCD elections by a margin of 258 votes, has moved a court here alleging malafide and corrupt practices in the conduct of polls in her ward and has sought a re-election.
Bimla Tyagi, who had contested the MCD election from ward no 7, Burari on a BJP ticket, moved the court of Additional District Judge Seema Maini alleging that malpractices were adopted in the election procedure to sway the result in favour of Congress candidate Aman Tyagi.
Bimla's counsel Santosh Pandey said in the petition that, "The petitioner (Bimla Tyagi) has every apprehension that the returning officer (RO) has worked in connivance with the Congress candidate and due to biasness and arbitrary act of the RO, the petitioner lost her election with a slight margin of 258 votes."
The petition alleged that the RO had improperly accepted the nomination of the Congress candidate as "she (Aman Tyagi) had submitted wrong information in her affidavit about movable and immovable assets of her spouse."
"The returning officer in connivance with the Congress candidate accpeted her affidavit which is another ground for re-election in ward no.7 Burari because had her papers been properly scrutinised, she may have been disqualified from contesting the election," the petitioner said.
She also alleged that many voters of Darshan Vihar, an area falling under Ward no 7, were compelled to cast their votes in ward no 6 even as their voter slips showed them as voters of ward no 7.
Claiming that "Darshan Vihar was shifted to ward no 6 with a malafide intention to benefit the Congress candidate," she alleged that the RO and the state election commission had published two voters lists for Darshan Vihar, one for to ward no 6 and other to ward no 7 but both the lists had the same voters.
She also claimed that "as per media reports on the day of counting of votes, she was ahead of the Congress candidate but in the last round of counting, the returning officer stopped the counting for snacks and when the counting resumed, the RO declared the Congress candidate as the winner."
