Man charged with raping 'minor' acquitted in Delhi

An Uttar Pradesh native facing trial for kidnapping and raping an alleged minor girl, whom he had later married, has been acquitted by a Delhi court after a U-turn by the girl's parents who said they had lodged the police complaint out of anger.

An Uttar Pradesh native facing trial for kidnapping and raping an alleged minor girl, whom he had later married, has been acquitted by a Delhi court after a U-turn by the girl's parents who said they had lodged the police complaint out of anger.

Additional sessions judge Madhu Jain acquitted Ashish Kumar, who hails from Rai Bareli, while also taking into the account the girl's deposition that she had eloped with the boy and had married him on her own and that she was above 19 years of age at the time of her marriage.

The girl's parents too retracted their statement which they had made in their complaint to the police and testified that their daughter was not a minor.

"The parents of the girl have deposed that she herself went with the accused and was a major at the time of the incident and they had lodged a report before the police in anger. Since there is no incriminating evidence against the accused, he is acquitted of the offence," said the ASJ.

Residents of Burari in North Delhi, the girl's parents had lodged a complaint with the local police that Ashish had kidnapped their minor daughter on January 24, 2010.

The accused was arrested later from his home, while the girl too was found there. The police also recovered a marriage certificate from them.

Later during the trial, while the girl deposed in favour of the boy, her parents too did a volte face and gave a clean chit to the accused. Her mother said she had reported the matter to the police as they were angry and there had been a "misunderstanding".

"Both the parents and the girl have stated on oath in the court that she was major on the date of incident and she herself went with the accused and now she is married with him and is living happily," the court said while acquitting Ashish.
