Man acquitted by Delhi court as victim fails to identify

A man, accused of attempting to murder another person, was acquitted by a Delhi court as the victim could not identify him.

A man, accused of making an attempt to murder another person after a collision between them on a street, was today acquitted by a Delhi court as the victim could not identify him during the trial.

Additional Sessions judge JR Aryan absolved Satender alias Satte, a resident of South Delhi, of the charge under section 307 (attempt to murder) of IPC after victim Savrej Alam testified that he cannot identify the accused.

"The complainant said that since it was dark, he could not see the face of the accused. The victim said it was not the accused who inflicted blade blows on him," the court said.

The victim said he did not name the accused in the FIR.

Alam, who was walking on a street at Kotla Mubarakpur locality here on the evening of November 28, 2006, got into a verbal fight with the accused with whom he had inadvertently collided, the prosecution said.

Later, the altercation turned ugly and the accused attacked at the victim's neck with a blade, Alam had allegedly said in the FIR and named the accused as culprit.

However, during the trial, he could not identify the accused and said he did not name Satender as the culprit in the FIR.
