Ketan Desai’s stay in new Gujarat University senate still uncertain

Now that the Gujarat University's senate election has had a peaceful end, the focus is once again on the issue of Ketan Desai's uncontested berth in the new senate.

The term of the last senate ended on December 6 and a new senate will be announced through a notification by the university vice-chancellor on Tuesday.

The decision on Ketan Desai's senate seat is also likely to come by Tuesday evening.

Ever since the news of the tainted doctor's uncontested senate berth surfaced on October 17, the university administration has been under tremendous pressure from several quarters. Many senate members as well as Medical Council of India (MCI) are demanding that he be prevented from becoming a senate member. Vice-chancellor Parimal Trivedi has informed the MCI that the university is seeking legal opinion in this regard.

However, many believe that this is a half-hearted attempt by the V-C as he himself can easily prevent Desai from coming to the senate by using the powers at his discretion.

But Trivedi has defended himself by saying that Desai can only be stopped by the outgoing senate, whose term ended this evening. Earlier, he had declared that before the tenure of the current senate gets over, the legal experts of the university will announce the final decision regarding Desai's omission.

Experts believe that it is a well planned strategy of Desai to handicap the university and the new senate so as to prevent them from quashing his candidature. This is because after the term of the current senate ends, it will be almost impossible to cancel his candidature.

In another twist to the story, a public interest litigation (PIL) was filed in the high court last week seeking the court's intervention in the matter. The PIL has been referred to the chief justice, who will start hearing on December 13. Since the matter is sub-judice now, many believe the university's decision on Ketan Desai will not be of great value.

Legal experts believe that since no interim order has been given by the court, the university can take its own decision. Now all eyes will be on the vice-chancellor on Tuesday as everyone is eager to know if Desai, who faces CBI inquiry in a disproportionate assets case, will be in or out of the senate.
