The Lok Ayukta Court today granted bail to former minister Katta Subramanya Naidu, his corporator son Jagadish and SV Srinivas, Managing Director of Itasca software firm, the main accused in Karnataka Industrial Area Development Board (KIADB) land scam.

Lok Ayukta court judge NK Sudhindra Rao granted bail to all three accused on "humanitarian grounds" while imposing certain conditions which included furnishing of personal bond of Rs5 lakh, two sureties for a similar sum and a direction not to tamper with prosecution witnesses.

Jagadish and Srinivas were also directed by the court not to enter the KIADB office without prior permission of the court and furnish certified extracts of all their bank accounts details from 2007 to till August eight, the date on which summons were issued to them.

The court also directed that in case Jagadish (A2) and Srinivas (A3) came in contact with A4 (Jaggaiah) and A5 (Venkaiah), who are absconding and against whom proclamations have been issued and separate chargesheets filed, they would communicate it to the Investigating Officer (IO).

The two shall not come in contact with any person in connection with the case.

Barring medical treatment for his father Katta Subramanya Naidu, who is sufferring from cancer, in London and him accompanying his father in this connection, they (A1 and A2) shall not move out of the country for any other reason after their return, the court said.

Barring their absence during their visit to London, Jagadish and Srinivas will mark their attendance before the IO every first and third Saturday between 1-2 pm.

The court warned that if any of the bail conditions were violated, the accused would be "invariably arrested". The former minister and his son are in judicial custody since August 8 in connection with KIADB land scam and irregularities in securing compensation for those whose lands were acquired.

While granting bail to Jagadish, the Judge said the "bail application requires to be considered on humanitarian grounds, considering it is not filed just for the purpose of bail application".

The court then adjourned the matter to Jan 16, 2012.

The court observed that the bail applications were made in the "changed circumstances and it was just and proper to grant bail to all three accused on humanitarian grounds. No prejudice will be caused to ends of justice if the three accused are granted bail".

Katta had already been given conditional bail for a three month period by Karnataka High Court, to undergo Stem Cell Transplant treatment in London for "lymphoma" as it had recurred in an "aggressive manner" and he had already been given an appointment on December 19, in Royal Hampstead Hospital, London for the purpose.

However, the bail applications of Jagadish and Srinivas were rejected both by the Lokayukta court and the High Court on earlier occasions.

Jagadish was today granted bail to accompany his father to London for treatment, as he was the only son and his mother was also suffering from many ailments.

Taking into account the apex court judgement cited by the accused in 2G Spectrum Case where the main accused had been granted bail, the court observed that Jagadish had already spent 122 days in judicial custody.

The court granted bail to Srinivas on health grounds since apart from other ailments, he recently suffered a slip disc for which he was admitted to National Institute of Mental Health and Neuro Sciences (NIMHANS) for two days where he had been advised "complete bed rest for two months" after which he was subsequently shifted back to Central Jail.

The court also considered the fact that along with Jagadish, Srinivas had also spent 122 days in judicial custody and the duo would cooperate with the court proceedings. P
