Katara case: Court issues notice on bail plea of accused

New Delhi: A Delhi court has issued a notice to the prosecution on a bail plea by Sukhdev Pehalwan, one of the accused in Nitish Katara murder case, who said he wants to take part in the wedding of his nephew.

Additional sessions judge JR Aryan has issued the notice to public prosecutor BS Joon for November 6. Pehalwan, whose trial was separated from that of Vikas Yadav and Vishal Yadav in the case as he had absconded, had filed the bail application on October 29.

"My nephew is getting married on November 19 and the family is in dire need of a responsible person to overlook and supervise all arrangements ... my elder brother, whose son is getting married, is not keeping well," the application said.

It also said Pehlawan cannot influence the trial and the examination of prosecution witnesses in the case was over. The court, after taking the application into records, fixed the matter for hearing on November six.

The Delhi High Court had recently granted conditional bail to convict Vikas, son of controversial Uttar Pradesh politician DP Yadav, to attend the marriage of his sister Bharati who allegedly had an intimate relation with victim Nitish Katara.

Earlier, the accused, recording his statement in response to evidence collected against him, had questioned the reliability of witness Ajay Katara. Pehalwan, along with Vikas and Vishal, allegedly killed Nitish on the intervening night of February 16/17, 2002.

Recording a statement under Section 313 (response of an accused on evidence collected against him) of the CrPC, Pehalwan had said Ajay Katara came as a witness at a very late stage and hailed from the same village as the victim.

Ajay had testified that he had last seen Nitish alive in the company of accused Vikas Yadav, Vishal and Sukhdev on the intervening night of February 16-17, 2002.
